Commissions

Let's Order a Commission!

So you want to order a commission! Yay! Be sure to check out the Terms of Service and my Sample Gallery as well as checking out the following section to see what information I need! By emailing me to order, I am assuming you have read & agreed to the TOS!


Order here by emailing me at: naux97.art@gmail.com with the subject "Commission Quote" following information:


  • Your Name
  • Your commission type [Digital 00s Graphic] or [Traditional Character Illustration]
  • Canvas Size: Digital 00s Graphics can be any size, but Traditional Illustrations are either 7x10 or 9x12in.
  • Subject Information: Reference sheets, character wiki link, pose photos, etc. any kind of supplemental information you have. If you want me to re/design an OC, written information is fine in lieu of pictures. If you want a digital design, what feeling or palette do you want.
  • Extra credit info: Your location for mailed commissions so I can include shipping in the quoted price, if you want it to be public/private, if you don't want it reproduced for prints, etc.

Process:

After emailing me and you agree to the quote I've sent, I'll send you an invoice on either Square or Paypal. For commissions under $75, payment is due upfront in full, for commissions over $75, we can work out a payment plan.

After the deposit or full payment is paid, I'll begin. After each step (design if needed, sketch, ink, color), I'll check in. You can make any revisions necessary during the sketch phrase. After it's inked, I can make minor revisions only. When it's fully completed and the payment is completed(if payment plan or sending shipping separately), I'll mail it to you via USPS with a thank you card & random goodies (trading card, sticker, print, etc.) This will be in a clear bag with a backer board to protect it.


For digital comms, there's no real rhyme or reason to my process, it's all vibes. I'll send it when I feel it's complete and you can make any revisions needed. When you're happy with it, I'll send you a 300DPI PNG.

TERMS: From here, I will be referred to as "the artist" or "NAUX" and you will be referred to as "the client" or "the commissioner." If you commission me, you are agreeing to the terms of service outlined here.


#1 Service:

A digital commission includes a 300DPI PNG of the finished graphic design, both with & without watermark/signature, delivered via email.


A traditional illustration will include the illustrated piece, an assortment of goodies i.e. a unique ATC, stickers, print, and a thank you card, unless otherwise stated, mailed to the client. This mailing will include a fee to be paid with the rest of the invoice or in a separate shipping invoice, as agreed by the client.


Commission requests will be replied to within 1-4 business days.


Commissions themselves can take anywhere between 2 to 21 days for digital or smaller traditional commissions (i.e. busts.) Larger commissions (9x12s, complex pieces) can take up to several months depending on supplies, waitlist, and other real life factors. Please message the artist for time estimates at the time of commission. The artist will keep in contact if there is some barrier to a decent timeframe for turnaround i.e. injury, lack of supply, etc.


#2 Rights


The artist retains all rights to all art that they produce. Artist rights include:

  • Reproducing the art for their portfolio
  • Posting the art on social media
  • Selling printed reproductions of the art

The commissioner retains all rights to characters that belong to them (i.e. OCs) or other intellectual property. IF the commissioner doesn't want the commission to be posted online for any reason or wishes to remain anonymous, this must be communicated up front. If it cannot be added to the portfolio/ common social media (hereby "socmed") such as Tumblr for any reason (privacy or violation of TOS such as explicit material, kink, etc), an additional fee may be charged, as the artist cannot use it to grow or attract new clientele.


Commissioner's Personal Use Rights include:

  • Reposting the art on socmed with credit to the artist as "NAUX" or NAUX97" or preferably with a link back to the NAUX NEOCITIES PAGE or NAUX TUMBLR.
  • Reproducing the art for single or private use such as making a phone case, a sticker, a print, a charm, etc.

Commissioner's Rights EXCLUDE :

  • Selling any copies whatsoever
  • Commercial use such as album or book covers, movies, or games.
  • Using the art for NFTs or training generative AI models.

Commercial use is defined as "use with any fare, fee, rate, charge, or consideration, even without profit being made." Should the commissioner want to use the commission for commercial art and/or media (album cover, comic cover, novel illustration, etc), they must discuss it with the artist at the time of commissioning. Commercial rights will incur a separate fee comparable to the usage in question.


The commissioner will not take money in exchange for copies of this commission or anything produced with this art. Copies or productions of the art may be given away i.e. as gifts for friends, tokens at a concert, so long as money or monetary gain is not in question.


Examples of OK and NOT OK behavior:

  • OK : The commissioner wants to print the digital commission to hang on their wall as a poster. That is okay because no money is being exchanged for goods with another person.
  • OK: The commissioner wants to print copies of their commission for token giveaways at a concert where it is common to exchange gifts to decorate concert bags. This is okay because no money is being exchanged for goods. Alternatively, the commissioner asks before the invoice is finalized if the artist will print copies of the commission in a different size (i.e. the commission is 7x10, and they want ATC sized prints) for the express purpose of giving away to friends or concert buddies in exchange for other items. This is also okay.
  • NOT OKAY: The commissioner produces prints of the commission to sell in their own shop or uses the commission as a bonus feature in their novel. Both of these are for profit, either as personal or commercial use, and are unacceptable.

The commissioner MAY resell fanart commissions if they so choose (i.e. for charity, because they don't care for the fandom anymore, etc.) The commissioner MAY NOT resell commissions of the artist's IP (such as OCs.) Examples: if you don't want art of Shoto Todoroki anymore because you've outgrown BNHA, that is okay, but you may not resell art of Sozoki.


This list of rights is non-exhaustive as the artist cannot think of every possible scenario. If you are unsure, please ask.


#3 Payment, Cancellations, Refunds


Payment is due before work begins. For commissions less than $75, it must be paid in full. For commissions over $75, the commissioner may propose a fair payment plan.


Prices on the artist website(s) are base prices and subject to change for reasons such as but not limited to additional supply cost, additional characters, inability to add to portfolio. Additionally, they may change in favor of the commissioner such as artist discounts, membership tier discounts, etc.


Invoices are sent either via Square or Paypal, whichever is agreed upon. At conventions, they may also be paid in cash. Invoices are sent after a price quote is agreed upon and the client has provided an email address.


The artist may cancel for any reason, before or during the process. In the case the artist cancels, the commissioner may receive up to 100% refund. If the commissioner cancels, they will be entitled to:

  • Before Final Sketch: 100%
  • After Inks: 50%
  • During Color: 0%.

Any reason for cancellation is valid. However, if the reason for cancellation is seeking refund because the commission is "taking too long," there will be no refund unless the digital commission has taken longer than 30 days, or the traditional commission has taken longer than six months.


All official communication will be via email or text message, whichever is preferred by the client. The client has four weeks between updates (sketch to ink, ink to color, after completion.) to confirm progress or make revisions and confirm shipping address is correct. If there is no response after 60 days (4 weeks+grace period), the artist will consider the commission abandoned. Abandoned commissions may be resold as originals in the artist's shop.

    Description:
  • A 7x10 or 9x12 traditional illustration of a character. Typically with a flat color background, "splash" background (sample #3) or signature cloud background.
  • Base Price: $150-$250


TRADITIONAL SHIP/MULTI CHARA

    Description:
  • A 7x10 or 9x12 traditional illustration of 2 OR more characters. Typically with a flat color background or signature cloud background.
  • Base Price: $250
